Hyderabad: Sindh High Court expresses concern over Ali Wazir’s long imprisonment, seeks reports

A constitutional bench of the Sindh High Court in Hyderabad has raised serious questions over the long imprisonment of former Member of National Assembly Ali Wazir and has sought detailed reports from the concerned authorities.

Ali Wazir is currently lodged in Central Jail-I Sukkur.

A constitutional bench comprising Justice Riazat Ali Sahar and Justice Arbab Ali Hakro heard a petition filed under Article 199 of the Constitution of Pakistan on March 3, 2026, challenging the legality of Ali Wazir’s detention.

The court, in its written order, stated that the law does not allow an accused to be detained for an indefinite period if no case is pending against him in the concerned court. The bench expressed serious concern over this situation.

Advocate Imdad Haider Solangi appeared for the petitioner while the Federation was represented by Assistant Attorney General Shamsuddin Rajpar along with Inspector Saeed Ahmed Sheikh of National Cyber ​​Crime Investigation Agency (NCCIA) Hyderabad. Assistant Advocate General Sindh Rafiq Ahmed Dahri also appeared in the court.

According to the court records, Ali Wazir was arrested under FIR No. 35/2025 registered at Police Station Airport Nawabshah under sections 123-A, 124-A and 124-B of the Pakistan Penal Code, read with sections 6 and 7 of the Anti-Terrorism Act 1997 and the case was pending in the Anti-Terrorism Court Shaheed Benazirabad.

However, on May 29, 2025, the Anti-Terrorism Court remanded the case back to the investigating officer on the grounds of lack of jurisdiction and declared that the previous proceedings in the court were extrajudicial. Despite this, Ali Wazir remained in judicial custody and no clear order was issued regarding his release.

The constitutional bench pointed out that despite the case being remanded, no appropriate order was issued for the release of the accused under Section 63 of the Code of Criminal Procedure Pakistan. The court also raised the question of on what legal basis Ali Wazir was kept in jail during the NCCIA inquiry.

During the hearing, the inquiry officer Inspector Saeed Ahmed Sheikh told the court that after the investigation, the final report dated June 23, 2025 was sent to the relevant authorities in Karachi for approval after signing on February 9, 2026.

The court has sought detailed reports from the Anti-Terrorism Court Shaheed Benazirabad, the Additional Director Zone Karachi of the NCCIA and the National Cyber ​​Crime Wing (South) Karachi on the current status of Ali Wazir’s detention and has ordered that all reports be submitted to the court before the next hearing, i.e. March 10, 2026.
