Former member of the National Assembly of Pakistan and leader of the Pashtun Tahafuz Movement, Ali Wazir, has approached the Sukkur bench of the Sindh High Court challenging the new terrorism FIR registered against him and has requested a stay on further arrests.<\/p>\n\n\n\n
The petition was filed under Article 199 of the Constitution, seeking quashing of FIR No. 93\/2026 registered at Dadu\u2019s A-Section police station, calling it \u201cfabricated\u201d.<\/p>\n\n\n\n
The petition has taken the stand that re-arresting a few hours after his release from the court is tantamount to \u201cunconstitutional kidnapping\u201d.<\/p>\n\n\n\n
According to the petition, Ali Wazir was released from Sukkur Central Jail on March 16, however, he was allegedly re-arrested by a large contingent of plainclothes personnel and police during a raid at a private location that same night.<\/p>\n\n\n\n
The petition alleges that torture was used during the operation, mobile phones were confiscated and threats were made to the people present there.<\/p>\n\n\n\n
The petition has taken the stand that the allegations made in the FIR do not correspond to the ground realities.<\/p>\n\n\n\n
According to the petitioner, it is not possible to be involved in any alleged criminal activity within a few hours of his release, and the registration of the FIR is in violation of the court\u2019s previous orders.<\/p>\n\n\n\n
The FIR includes serious provisions of the Pakistan Penal Code and the Anti-Terrorism Act, which include allegations such as raising anti-state slogans, blocking roads and firing on police.<\/p>\n\n\n\n
Earlier, the Sindh High Court\u2019s constitutional bench had declared Ali Wazir\u2019s detention illegal, saying that detention without any pending case or investigation is a violation of Article 9 of the Constitution.<\/p>\n\n\n\n
The petition also states that since 2024, detention orders have been issued against Ali Wazir in various provinces under several cases and MPOs.<\/p>\n\n\n\n
According to the lawyers, whenever bail is granted in a case, a new case is registered in another district, which they termed as a \u201cstrategy to render court orders ineffective.\u201d<\/p>\n\n\n\n
A bench comprising Justice Amjad Bohio and Justice Ali Haider Ada will hear the petition on March 30.<\/p>\n","protected":false},"excerpt":{"rendered":"
