{"id":1630,"date":"2026-05-05T18:33:57","date_gmt":"2026-05-05T18:33:57","guid":{"rendered":"https:\/\/kashgilnews.com\/english\/?p=1630"},"modified":"2026-05-05T18:33:58","modified_gmt":"2026-05-05T18:33:58","slug":"constitution-and-law-in-azad-kashmir-subordinate-to-political-elite","status":"publish","type":"post","link":"https:\/\/kashgilnews.com\/english\/1630\/","title":{"rendered":"Constitution and law in Azad Kashmir subordinate to political elite"},"content":{"rendered":"\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">By: Zulfiqar Ali<\/mark><\/strong><\/p>\n\n\n\n<p>The Acting President of Azad Jammu and Kashmir has remained in office beyond the time allowed by the Constitution, raising serious questions about respect for the rule of law by the political and administrative elite in the region. The office of the President fell vacant after the President died on 30 January this year. Under the Constitution, a new President must be elected within 30 days. That deadline has now been missed by around 65 days, and no election has been held.<\/p>\n\n\n\n<p>According to Section 9 of the Constitution, when the office of President becomes vacant due to death, resignation, or any other reason, the Speaker of the Assembly must: (a) act as President until a new one is elected; and (b) ensure that the election is held within 30 days of the vacancy. The only exception is if the Assembly is dissolved. In that case, the election must be held within 30 days after the general elections. This means there is no legal justification to delay the election unless the Assembly is dissolved. Any deliberate delay goes against the Constitution and violates the oath to uphold it.<\/p>\n\n\n\n<p>Under Article 50, the Election Commission is responsible for organising, managing, and conducting elections for the Assembly, local bodies, President, and Prime Minister. It must ensure that elections are free, fair, and in line with the law. Despite this, the Acting President continues to hold office beyond the allowed period and is exercising full presidential powers.<\/p>\n\n\n\n<p>He is also reported to be using the benefits of both roles at the same time. These include the Speaker\u2019s office and official residence in Muzaffarabad, as well as the Speaker\u2019s chamber in Islamabad. At the same time, the President\u2019s offices and residences in both Muzaffarabad and Islamabad are also reportedly in use. Official vehicles, security, and state protocol linked to both positions are also said to be in use simultaneously.<\/p>\n\n\n\n<p>During this period, key appointments have also been made under the authority of the acting role. The ruling party, Pakistan Peoples Party (PPP), with which the Acting President is affiliated, as well as the main opposition parties \u2014 Pakistan Muslim League-Nawaz (PML-N), Pakistan Tehreek-e-Insaf (PTI), Muslim Conference, and Jammu and Kashmir Peoples Party \u2014 have remained silent over what critics describe as a clear and open breach of the Constitution.<\/p>\n\n\n\n<p>This is not the first time the Constitution has been violated. Critics say it has become a pattern. When any part of the Constitution stands in the way of the political elite, it is either changed or ignored to serve political and financial interests.<\/p>\n\n\n\n<p>The Acting President was elected as Speaker in early June 2023 in controversial circumstances. He secured only 19 votes in a 53-member House, despite a simple majority of 27 being required.<\/p>\n\n\n\n<p>But the concerns do not end there. On 20 April 2023, a coalition government was formed in Azad Jammu and Kashmir, led by PTI forward bloc leader Chaudhry Anwar ul Haq, with the Pakistan Peoples Party and Pakistan Muslim League also part of the government. Chaudhry Anwar ul Haq was serving as Speaker when he contested the election for Prime Minister and secured 48 votes in the 53-member Assembly. After taking oath as Prime Minister, he continued to act as Speaker and even adjourned Assembly proceedings in that role. This constitutional breach was enabled by the Assembly itself, which voted for him while he was also acting as Speaker.<\/p>\n\n\n\n<p>The pattern of breaching, ignoring, or reshaping the Constitution for personal and political gain does not end here. In 2018, the Azad Jammu and Kashmir Assembly passed the 13th Amendment, transferring financial powers from the Jammu and Kashmir Council to the AJK government \u2014 a move widely celebrated by the political leadership. The amendment also placed a cap on the number of ministers, limiting it to 16. However, when the same political elite found this restriction inconvenient, the law was changed and the cap was removed.<\/p>\n\n\n\n<p>To avoid accountability, changes were also made to the Accountability laws in 2020 by the Assembly, weakening the institution. In 2024, the Assembly amended Section 505 of the 1960 law, granting broad protection to the political system from criticism. The amendment criminalised criticism, with penalties of up to seven years in prison and fines.<\/p>\n\n\n\n<p>In April 2025, the \u201cManual (Dastoor-ul-Amal)\u201d was given legal cover by the Assembly, allowing members of the Assembly to continue controlling local government development funds, despite a High Court ruling against the practice \u2014 raising concerns about continued misuse of public resources.<\/p>\n\n\n\n<p>In Azad Kashmir, many now say the Constitution is bent to protect personal, political, and financial interests, leaving the region weakened by the absence of genuine rule of law.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">***<\/mark><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By: Zulfiqar Ali The Acting President of Azad Jammu and Kashmir has remained in office beyond the time allowed by the Constitution, raising serious questions about respect for the rule of law by the political and administrative elite in the region.
