Pakistani Kashmir: Inquiry ordered against police officers and employees for making fake drug case, accused acquitted

In Pakistan-administered Kashmir, District Sessions Judge Poonch Rawalakot Raja Faisal Majeed Khan has acquitted accused Ali Javed son of Muhammad Javed resident of Chhota Gula tehsil Rawalakot in a drug case under section CNSA.9C and initiated judicial/criminal proceedings against the accused/Sub-Inspector Waqas Basharat, Investigation Officer Muhammad Shabbir ASI and false witnesses for making a fake and false case under sections 193, 211, 182 of the Jammu and Kashmir Penal Code and CNSA-26 and has also directed SSP Poonch to take departmental action against all police officers/employees who are involved in this case and have given false testimonies.

This is probably the first case of its kind in Jammu and Kashmir in which the accused has been acquitted and departmental disciplinary action has been initiated against the accused, the Sub-Inspector, Investigation Officer Muhammad Shabbir ASI, police officers and officials and prosecution witnesses, in addition to criminal/judicial action.

In this case, on 28.06.2025, the Sub-Inspector of Police Chowki Khaigalla had arrested the accused from the Chota Gulla University Campus (under construction) and charged him with recovering 1020 grams of hashish.

The court also declared the accused entitled to compensation for (10) months of arrest and ordered the immediate release of the accused from the District Jail Poonch.

The case was pursued by Sardar Abdul Samad Advocate on behalf of the accused.

Local sources say that the accused was arrested during the game and the reason for the arrest was a dispute with the police over something, due to which he was targeted for revenge and a drug case was made.

This is the first time that the court has held the police responsible for making a false drug case and ordered an inquiry.
